Terms of Use — Eden Coloring

These terms are the agreement between you and Eden Apps, a sole proprietor based in Texas, USA ("we", "us"), for the use of Eden Coloring. By using the app you accept them.
Using the app
We give you a personal, non-transferable licence to use Eden Coloring on devices you own or control, for your own enjoyment. You may not resell the app, or extract and redistribute the artwork it contains.
The artwork in the app
The colouring pages that ship with Eden Coloring belong to Eden Apps. You are welcome to colour them, keep them, print them, and share pictures of your finished work — including publicly and on social media. You may not sell the original line art, or redistribute the pages as a colouring collection of your own.
Drawings you bring in
Anything you import stays yours. It is stored only on your device; we never receive it and could not access it.
You are responsible for what you import. Please only bring in drawings you made or have the right to use — importing someone else's artwork without permission may infringe their copyright.
Your colourings
Your colourings are yours. We claim no rights over them.
Eden Pro
Eden Pro is a one-time purchase, not a subscription. It unlocks the pages that are not already free, on the Apple ID that bought it, and it does not expire. You can restore it on a new device from your profile.
Purchases are made through Apple, and Apple's terms and refund process apply. Refunds are requested from Apple, not from us.
What we don't promise
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We work to keep the app functioning well, but we cannot promise it will be free of every fault, or that it will always be available.
Your colourings live on your device, which means they are only as safe as your device and its backups. We hold no copy and cannot recover your work if the device is lost, damaged, or reset, or if the app is deleted. Please keep your device backed up.
To the extent the law allows, we are not liable for indirect or consequential loss arising from your use of the app, and our total liability for any claim relating to the app will not exceed the amount you paid for it. Nothing in these terms removes rights you have under consumer law in your country.
Apple and the App Store
Eden Coloring is downloaded through Apple's App Store, and a few terms follow from that:
- This agreement is between you and Eden Apps only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any warranty, you may notify Apple, and Apple will refund the purchase price to you (if any). To the maximum extent allowed by law, Apple has no other warranty obligation with respect to the app.
- Eden Apps, not Apple, is responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to meet a legal requirement, and claims arising under consumer-protection or privacy law.
- Eden Apps, not Apple, is responsible for investigating and resolving any third-party claim that the app infringes that party's intellectual-property rights.
- You confirm that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of these terms Apple will have the right to enforce them against you as a third-party beneficiary.
Changes
We may update these terms. If we do, the date at the top changes, and continuing to use the app means accepting the revised version.
General
If any part of these terms is found unenforceable, the rest stays in effect. These terms, together with our Privacy Policy, are the entire agreement between you and us about the app.
Governing law
These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law principles.
